The terms for using Dad Shift and Mom Shift.

Who we are

Dad Shift and Mom Shift are published by Tom Van De Putte, in Belgium (“we”). He is the trader that provides the apps and what you can buy in them.

The license

The apps are licensed to you under Apple's Licensed Application End User License Agreement, which applies to every app in the App Store. These terms add what is specific to Dad Shift and Mom Shift. Nothing in that agreement or in these terms takes away the rights you have as a consumer under the mandatory law of the country where you live.

Health information

The apps provide general information drawn from published sources, each dated. They are not medical advice and not medical devices, they do not diagnose, screen or recommend treatment, and using them does not create a doctor–patient relationship. Clinical decisions rest with your healthcare providers.

If something could be an emergency, call the emergency number straight away: 112 in Belgium, the Netherlands, France and the rest of Europe, and 911 in Canada and the United States. Elsewhere, use the local emergency number.

The vaccination card records what you enter. It does not recommend, schedule or track whether vaccines are due; your child's doctor decides.

Money

Figures in the money planner are illustrative estimates you can change. They are not financial advice.

Purchases and renewal

Purchases are made through the App Store and paid to Apple. The price, with the taxes that apply to you, is shown by Apple before you confirm. A pass covers one baby, both parents and both apps, and lasts until that baby's first birthday plus three months, and never less than three months from purchase. The monthly plan renews each month until you cancel it in your Apple Account's subscriptions; it then ends when the period you have paid for is over.

Withdrawal and refunds

If you live in the European Union, you normally have 14 days to withdraw from a purchase made at a distance. For digital content delivered at once, such as a pass, that right ends when delivery begins with your agreement and your acknowledgement that you lose it (Directive 2011/83/EU, Article 16(m)). Apple takes the payment and handles refund and withdrawal requests under its own terms. We cannot see your payment and cannot refund it ourselves.

Your legal guarantee

As a consumer in the European Union, you are protected by a legal guarantee of conformity for digital content (Directive (EU) 2019/770, in force in every member state). The apps must work as described and be fit for what such apps are normally used for. If they do not, you can ask us to put it right; if we do not, or cannot, you may be entitled to a price reduction or to end the contract. For a one-time purchase such as the pass, we answer for a defect that exists when the app is supplied and shows within at least two years; for the monthly plan, for as long as it runs. In Canada, the consumer protection law of your province, in Québec the Consumer Protection Act, applies and cannot be waived.

Your data

What you record is yours and stays on your devices unless you switch on iCloud sync, share a baby with the other parent or switch on the weather. See the privacy notice.

Governing law and courts

These terms, and your use of the apps, are governed by Belgian law. If you are a consumer, this does not deprive you of the mandatory protection of the law of the country where you live. Belgian courts have jurisdiction. If you are a consumer, you may also bring proceedings in the courts of the country, or in Canada the province, where you live, and we can bring proceedings against you only there.

If something goes wrong, write to us first. We would rather solve it with you than in court.

Languages

These terms are published in English, French and Dutch and say the same thing. If you read them in French or Dutch, that version is the one that applies to you. If you find a difference, tell us.

Changes

If these terms change, the new version is posted here with a new date. A change will not take away what you have already paid for.
